By accessing or using Conversa ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Service.

2. Description of Service

Conversa provides AI-powered voice calling services designed to help e-commerce businesses recover abandoned checkouts. Our Service integrates with Shopify and other platforms to automate customer outreach.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations, including TCPA, GDPR, and CAN-SPAM
  • Make calls to numbers on the Do Not Call registry without proper consent
  • Engage in spam, fraud, or misleading practices
  • Harass, abuse, or harm other individuals
  • Interfere with or disrupt the Service or servers

5. Compliance with Calling Regulations

You are responsible for ensuring compliance with all applicable telecommunications laws, including but not limited to:

  • Telephone Consumer Protection Act (TCPA)
  • Do Not Call (DNC) registry requirements
  • State-specific calling regulations
  • International calling laws for cross-border communications

You must obtain proper consent before placing automated calls to customers and maintain records of such consent.

6. Billing and Payments

Billing for the Service is processed through Shopify. You agree to:

  • Pay all charges associated with your use of the Service
  • Provide accurate billing information
  • Accept usage-based charges for call volume

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Conversa and are protected by international copyright, trademark, and other intellectual property laws.

9. Limitation of Liability

IN NO EVENT SHALL CONVERSA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.
